Who is Brady Mistic ?

Brady Mistic was jailed for four months on charges of second-degree assault on a police officer and resisting arrest following the violent arrest in September 2019. The charges were ultimately dropped and Mistic was released, the lawsuit says.


A deaf man is suing two Colorado police officers who smashed his head against concrete and beat him for “resisting arrest” after not realizing that he could not listen to their instructions.

Now Mistic is suing officers Nicholas Hanning and Ellie Summers, seeking unspecified compensation for the pain and suffering, for claims that officers did not give a ‘warning or attempt to communicate’ before throwing him to the ground. He is also suing the city of Idaho Springs and the Clear Creek County Board of County Commissioners.


Hanning was fired from the department in July in connection with another violent arrest, while Summers currently remains on active duty.

The incident began on September 17, 2019, when Mistic was arrested for allegedly executing a stop sign.

According to the lawsuit, Mistic did not realize that he had done something illegal and stopped in the parking lot of a laundry, got out of his car and started walking towards the building. After his arrest, he lost his car.

He didn’t realize that Hanning and Summers had pulled up behind him until he saw the flashing lights of his police vehicle.

“ When Mr. Mistic got out of his car and passed a garbage container between his vehicle and the police vehicle, towards the door of the laundry, the lights of the police vehicle blinded him and / or the officers they shone a spotlight, ” the lawsuit says.

“He had no idea what was going on, what the police were doing or if the presence of the officers had anything to do with him.”

Mistic, who cannot read lips and can only form a few words verbally, relies on American Sign Language to communicate.

He tried to use his hands to communicate with officers, but to no avail, the lawsuit alleges.

Hanning was fired in July and faces charges for the arrest of 75-year-old Michael Clark.

Mistic is then thrown to the ground, banging his head against concrete, without “warning or attempt to communicate,” according to the lawsuit.

Prosecutors said he did not reveal that he was part of the police force when he knocked on Clark’s door and used his stun gun 19 seconds after the man lowered his weapon.

Hanning has since been fired from the Idaho Springs Police Department.

The other officer involved in Mistic’s arrest, Ellie Summers, was also part of Clark’s arrest in May. She and Hanning are both named in a separate lawsuit filed by Clark in July.

Summers is still on active duty.
