A month after a 50-year-old woman’s arrest for allegedly abusing a 3-year-old at a San Antonio daycare, a lawsuit has been filed on behalf of the victim’s parents.
In an emailed statement to CrimeOnline, law firms Kherkher Garcia, LLP, and Ali Law Group, PLLC, stated that the lawsuit, filed February 5, named KIDUS Daycare as the defendant, along with its parent company, JPR International Inc., and Veronica Jimenez.
The lawsuit has been filed on behalf of Ali and Hoda Ibrahim, the parents of a toddler injured while under Jiminez’s care on January 6. The alleged incident occurred inside one of the classrooms at the daycare, located off Bulverde Road.
Security footage obtained by the firms showed Jimenez grabbing a male child by the arm, causing him to hit his head and fall down. According to the lawsuit, the child had been playing near a “near a rolling classroom caddy,” when it tipped and fell over.
“It shows daycare provider Veronica Jiminez reacting immediately, visibly angry, and charging toward the young boy,” the lawsuit stated.
“Jiminez violently struck and shoved the toddler launching his body into a nearby caddy where his face and head slammed into the exposed metal bars, causing immediate injury that required emergency medical attention.”
Upon reviewing the footage, deputies with the Bexar County Sheriff’s Office arrested Jiminez. She’s been charged with felony injury to a child—reckless bodily injury.
Along with court costs and other damages, the defendants are seeking $1 million and $5 million for gross negligence, which includes:
- Failure to adopt, enforce, and maintain reasonable safety measures
- Negligent hiring, training, and supervision
- Failure to maintain reasonable safety measures, including operational controls needed to protect children from injury
Jimenez has since been fired from her position at the daycare. KSAT 12 reports that she is also out of jail, on a $30,000 bond.
