CBS News, which provided initial the initial coverage of the document, spun the statistics to argue that that “only” around 14 percent of around 400,000 of the illegals it covered had charges or convictions for violent criminal offenses, specifically—a still-significant 56,000 violent migrants—but this was likely reduced by plea deals, which often involve suspects initially arrested for multiple crimes, including violent crimes, agreeing to admit to a selection of less serious crimes in exchange for lighter charges.
The White House characterized CBS’s framing of the statistics as “Fake News,” stressing that crimes categorized as “non-violent” include serious offenses such as “[d]rug trafficking, human smuggling, child porn, fraud, DUI, burglary, etc.” The White House also stated that the share of arrested migrants with prior criminal charges or convictions is actually around 70 percent, not 60 percent.

Notably, crossing the U.S. border illegally is a criminal offense, meaning that any migrant arriving in the country by this method is a criminal. Overstaying a visa is only a civil violation, but it is often accompanied by criminal offenses, such as willful tax evasion.
