Details Of Kristy Scott’s Petition Requesting Divorce From Desmond Scott Reportedly Revealed

On Tuesday, January 13, US Weekly published an exclusive report revealing the additional details included in Kristy Scott’s divorce petition. Per the outlet, in her filing, made on December 30, 2025, Kristy asserted that her estranged husband “committed adultery.”

Additionally, she reportedly noted that their marriage had become “insupportable because of discord or conflict of personalities.” Thus, this “destroys the legitimate ends of the marriage relationship and prevents any reasonable expectation of reconciliation,” Kristy reportedly asserted.

Furthermore, Kristy reportedly did not note additional information about Desmond’s alleged infidelity. US Weekly notes that the state of Texas considers adultery as “the voluntary sexual intercourse of a married person with someone other than their spouse.” The outlet adds that the state appears to assert that “emotional affairs, sending inappropriate text messages, or spending time with another person are not, by themselves, considered legal adultery.”

What Happens With Custody And Their Property? Will There Be A Name Change?

Per the outlet, the pair’s two children, Vance, who is seven, and Westin, who is six, will be under conditions set by both Kristy and Desmond in a mutual “written agreement about custody, access, and support.” However, the filing reportedly added that if the pair cannot agree on terms, Kristy would like the court to decide.

Additionally, the filing asserts that the pair has a “marital property agreement.” The document reportedly outlines who will walk away with what property, “both community and separate.” Furthermore, the pair still has to decide how they will split their “community estate,” which appears to refer to their newly built “dream home.”

As for whether her name will be “Kristy Scott” moving forward, Kristy is reportedly switching things up. She reportedly asked the court to return her name to “Kristy Small.” Lastly, she also asked that Desmond pay her attorney fees and court costs.

Kristy Scott filed for divorce on December 30, then on January 10, Desmond Scott addressed the filing as the news of it made its rounds. As The Shade Room previously reported, Desmond shared his thoughts via his Instagram Story.
