Jack Smith Reportedly Under Investigation for Violating Hatch Act – RedState

Former Special Counsel Jack Smith, who led two failed investigations into Donald Trump over election interference and classified documents, is now reportedly under investigation himself by the U.S. Office of Special Counsel (OSC) for potentially violating the Hatch Act during his relentless pursuit of Trump.





An email reviewed by The [NY] Post states The Hatch Act Unit, which enforces a law restricting government employees from engaging in political activities, has begun reviewing the former Special Counsel for the United States Department of Justice. The email was written by Senior Counsel Charles Baldis at OSC.

The next line in the letter almost made me laugh out loud (emphasis mine):

I appreciate the Office of Special Counsel taking this seriously and launching an investigation into Jack Smith’s conduct. No one is above the law.

“No one is above the law” is a phrase that Smith used repeatedly as he angled to kneecap Trump’s 2024 presidential campaign and get him thrown behind bars.

Senate Intelligence Committee Chair Tom Cotton (R-AR) had been strongly urging an investigation into Smith’s politicizing of his office and letting his obvious disdain for Trump cloud his vision:





Cotton responded to the news of the new investigation, saying: “Jack Smith’s actions were clearly driven to hurt President Trump’s election, and Smith should be held fully accountable.”

As RedState reported extensively, Smith went out of his way to put his thumb on the scales of justice and seemed to be operating at the behest of the DNC:

In his letter to OSC, Cotton explains how Smith’s actions undermined Trump’s political efforts.

“Jack Smith’s legal actions were nothing more than a tool for the Biden and Harris campaigns. This isn’t just unethical, it is very likely illegal campaign activity from a public office,” Cotton said. 

“Many of Smith’s legal actions seem to have no rationale except for an attempt to affect the 2024 election results – actions that would violate federal law.”

The U.S. Office of Special Counsel (OSC) is an independent federal investigative and prosecutorial agency. OSC’s statutory authority comes from four federal laws: the Civil Service Reform Act, the Whistleblower Protection Act, the Hatch Act, and the Uniformed Services Employment & Reemployment Rights Act (USERRA).

Notice the word “prosecutorial”—meaning they have teeth, and can do more than just write strongly-worded letters.

We’ll see whether formal charges are filed, but in the meantime, Jack Smith is getting a taste of his own medicine. Glass houses and all that…
