Representative Brandon Gill (R-TX) has introduced articles of impeachment against U.S. District Court Judge James Boasberg for his role in the “Arctic Frost” scandal. The resolution accuses Boasberg of abuse of power, alleging that he compromised judicial impartiality and allowed Biden Department of Justice (DOJ) special counsel Jack Smith to target Republican lawmakers, operatives, and organizations in a politically motivated probe.

“Chief Judge Boasberg has compromised the impartiality of the judiciary and created a constitutional crisis. He is shamelessly weaponizing his power against his political opponents, including Republican members of Congress who are faithfully serving the American people within their jurisdiction,” Gill said regarding his impeachment resolution. “I am proud to once again introduce articles of impeachment against Judge Boasberg to hold him accountable for his high crimes and misdemeanors.”

The Arctic Frost scandal, which involved subpoenas and gag orders signed by Boasberg, targeted phone records of 10 Republican senators and one House lawmaker. Additionally, Smith—who took over Arctic Frost in 2023—expanded the probe, issuing subpoenas against over 430 Republican operatives, leaders, and organizations. Smith appeared to be preparing an unprecedented RICO prosecution aimed at crippling the Republican Party’s election efforts and preventing President Donald J. Trump from running in the 2024 election.

Redacted documents, made public by Sen. Chuck Grassley (R-IA), revealed that Verizon complied with the gag orders, while AT&T did not. While federal judges have discretion in approving such orders under the Stored Communications Act, Republicans argue that Boasberg’s decisions violated the speech and debate clause of the U.S. Constitution, which protects lawmakers from being questioned for actions within their legislative roles.

Boasberg has faced Republican criticism before, including threats of impeachment earlier this year after his order temporarily paused Trump’s illegal immigrant deportation flights to El Salvador.
