Todd Tucker has reportedly demanded primary custody and questioned his prenuptial agreement after Kandi Burruss announced their divorce.

Todd Tucker Reportedly Demands Primary Custody & Questions Prenuptial Agreement With Kandi Burruss
On Monday, December 1, US Weekly published an exclusive report. This, asserting that on Wednesday, November 26, Tucker filed his response to Burruss’s divorce petition. In his response, Tucker reportedly asserted that their two kids, Ace and Blaze, have been in his care and are living with him in Georgia. This, so that Burruss can handle “out-of-state work obligations.”
Furthermore, Tucker reportedly noted that these work obligations “will continue to require [Burruss] to be away from the children for at least the next several months.” Therefore, he is requesting primary custody of Ace and Blaze.
In his response, Tucker reportedly noted that he and his estranged wife have been “working cooperatively in an effort to resolve all issues” in “good faith.” However, he added that” in the hopefully unlikely event” that he and Burruss cannot reach an agreement, he plans to pursue “primary physical custody, joint legal custody, and final decision-making authority.”
“[Tucker] wishes to make clear that he recognizes [Burruss] as a loving and capable parent and remains sincerely hopeful that prior and continued discussions between the parties will bring full resolution of all matters,” his filing reportedly noted.

Per the outlet, Tucker noted that he signed a prenuptial agreement before the pair wed in 2014. However, he alleged that he was “pressured into signing it without his lawyers around.”
“[The agreement] was presented to [Tucker], without [Tucker] having counsel, even though [Burruss’] then counsel had communicated previously with [Tucker’s team] regarding a potential prenuptial agreement,” Tucker’s legal team reportedly noted in his filing. “… These circumstances raise substantial questions concerning the enforceability of said document. Nevertheless, [Tucker] remains committed to working in good faith to resolve this matter amicably and privately to the extent possible.”
Lastly, Tucker reportedly noted that he may ask for “alimony if the prenuptial agreement is found to be unenforceable.”

As The Shade Room previously reported, Kandi Burruss publicly announced her and Todd Tucker’s divorce on November 21, the same day of her filing. At the time, she reportedly listed their date of separation as July 15, 2025, citing that their marriage was “irretrievably broken.” In her filing, she reportedly noted her and Tucker’s joint custody and asked that their prenup be enforced.
“Parties possess debts that have been incurred throughout the duration of the marriage, which should be subject to equitable division directed by the Prenuptial Agreement,” her filing reportedly added while noting that child support should also be determined.
Then, on Saturday, November 22, Burruss and Tucker reconvened to celebrate their daughter’s sixth birthday. Photos from the outing appeared to show that the pair were amicable. To add, ahead of the Thanksgiving holiday, Burruss opened up about their plans to spend the day alongside their children.
